Introduction

This agreement contains the complete Terms and Conditions that apply to you after registration and making a purchase on FAINA. By using or shopping at e-store, you agree to be bound by its terms of use and shall comply thereof. This agreement describes and encompasses the entire arrangement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to FAINA, the content and computer programs provided by or through the e-store, and the subject matter of this agreement. Amendments to this arrangement can be made and effected by us from time to time without specific notice to your end. Terms and Conditions posted on FAINA reflects the latest agreement, it is obligatory to get acquainted with it before making a purchase on our e-store.

Payments

FAINA has the sole discretion to provide the terms of payment. Unless other term has been agreed upon, payment for the products shall be made by Visa, Mastercard, PayPal or direct bank transfer . If the preferred method of payment is by invoice, invoices are due and payable within the time period agreed. FAINA has all the discretion to cancel or deny orders. FAINA is not responsible for pricing, typographical or other errors and we reserve the right to cancel any orders arising from such errors.

Risk of loss

All items purchased from FAINA are insured in accordance to the shipping contract. The parcel is declared to be lost if the delay in delivery reaches up to two months. In the case of lost parcel our contractor will be notified and after series of investigations, if the parcel is still missing, you will be compensated for the full amount of your order. Customer will always have an option to request a replacement, depending on the availability.

Pricing & Description

Prices displayed for products on FAINA represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. We do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered in our website is not as described, your sole remedy is to return it in unused condition.
The goods offered at FAINA are presented on the Website in the form of digital photographs of the actual products. Minor discrepancies between the presentation and the actual products do not qualify as a defect in the goods ordered.

FAINA does not take responsibility for duties and taxes, which may apply in the country of delivery.

Fraud

Fraudulent Activities are highly monitored in our site and if fraud is detected FAINA shall resort all remedies available to us, and you shall be responsible for all costs and legal fees arising from these fraudulent activities.

Promotion Code

Promotion codes have different time periods of validity and are applicable for purchase of any product available on the website. To determine the validity period, please refer to the document which contains the promotion code.
Exchanges or reimbursements of promotion codes are non-permissible. FAINA cannot be held responsible for any fraudulent or non-authorised uses of promotion codes.
FAINA reserves the right to cancel or block the promotion code, if deemed necessary due to legal reasons, for example, in case of loss or misuse of the promotion code. You will be informed immediately  in the case of cancelling or blocking the promotion code.

Acknowledgment of rights

You hereby acknowledge that all rights, titles and interests, including but not limited to rights are covered by the Intellectual Property Rights. You will not acquire any right, title, or interest in or to the program expressly set in this agreement. You hereby agree that you will not modify, adapt, translate, prepare derivative works, decompile, reverse engineer, disassemble or attempt to derive source code from any of our services, software, documentation, as well as create or attempt to create a substitute or similar service or product through use of or access to the program or proprietary information related thereto.

Confidentiality

You agree not to disclose information you obtain from us and or from our clients, advertisers and suppliers. All information submitted to by an end-user customer pursuant to a Program is proprietary information of FAINA. Such customer information is confidential and may not be disclosed. Publisher agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.

Processing of personal data
What personal data are processed

  • name, phone number and email address;
  • delivery address;
  • cost of goods and services and data related to payments (purchase history);
  • customer support data.

Why personal data are processed

Personal data are used to manage the customer’s orders and deliver goods.
Purchase history details (date of purchase, goods, quantity, customer’s data) are used for preparing summaries of goods and services purchased and for analysing customer preferences.
Personal data such as email, phone number and the customer’s name are processed to handle any issues relating to the provision of goods and services (customer support).
The IP address or other web identifiers of a user of the online shop are processed for the provision of the online shop as an information society service and for web use statistics.

Legal grounds

Personal data are processed for the purpose of performing a contract concluded with the customer.
Personal data are processed for performing legal obligations (such as accounting and the settlement of consumer complaints).

Recipient of personal data

Personal data are transmitted to the customer support of the online shop for managing purchases and purchase history and for settling any problems that the customers may have.
The name, phone number and email address are transmitted to the transport service provider selected by the customer. When the goods are delivered by a courier, the customer’s address is also transmitted together with the contact details.
If the accounts of the web shop are kept by a service provider, the personal data are transmitted to the service provider for performing accounting operations.
Personal data may be transmitted to IT service providers if this is necessary for ensuring the functionality of the online shop or for data hosting.

Access to and rectification of personal data

Personal data can be accessed and rectified in the user profile of the online shop. When a purchase has been made without a user account, personal data can be accessed through customer support.

Withdrawal of consent

Where personal data are processed on the basis of the customer’s consent, the customer has the right to withdraw his/her consent by notifying customer support by email.

Direct marketing messages

Email address and phone number are used for sending direct marketing messages if the customer has given the respective consent. If the customer does not want to receive direct marketing messages, the customer should select the relevant link at the footer of the email or contact customer service.
Where personal data are processed for direct marketing purposes (profiling), the customer has the right to object at any time both to the initial and further processing of his/her personal data, including profiling related to direct marketing by notifying customer support thereof via email.
